Terms of Service

Welcome to Source Interactive. These Terms of Service (“Terms”) govern your access to and use of the website located at www.source-interactive.com (the “Site”), together with any games, game clients, game servers, downloadable content, digital goods, APIs, forums, social features, and related services we make available (collectively, the “Services”).

The Services are operated by Source Interactive LLC (“Source Interactive,” “we,” “us,” or “our”). By accessing or using the Services, you (“you,” “your,” or “User”) agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, do not access or use the Services.

1. Eligibility

You must be at least 13 years of age to use the Services. If you are between 13 and the age of majority in your jurisdiction, you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. Certain features, including purchases, tournaments, or Web3 functionality, may require you to be 18 or older. By using the Services you represent that you meet these requirements and that you are not barred from using the Services under the laws of the United States or any other applicable jurisdiction.

2. Accounts

To access certain features you may need to create an account or sign in using a third-party identity provider (for example, Google, Apple, Discord, or TikTok). You are responsible for:

Providing accurate, current, and complete information.
Maintaining the confidentiality of your credentials.
All activity that occurs under your account.

You must notify us promptly at source.interactive.games@gmail.com of any unauthorized access or suspected breach. We may suspend, limit, or terminate accounts at our discretion, including for violations of these Terms, suspected fraud, chargebacks, or abusive conduct.

3. License to Use the Services

Subject to your compliance with these Terms, Source Interactive grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial entertainment. All rights not expressly granted are reserved.

You may not:

Copy, modify, distribute, sell, lease, or create derivative works of any portion of the Services.
Reverse engineer, decompile, or attempt to extract source code, except to the limited extent applicable law expressly permits.
Use bots, scrapers, cheats, exploits, automation tools, or modified clients.
Use the Services to build a competing product or to train machine-learning models without our prior written consent.

4. User-Generated Content

The Services may allow you to submit, post, link, stream, upload, or otherwise make available text, images, video, audio, gameplay recordings, usernames, profiles, comments, chat messages, forum posts, mods, and other content (“User Content”).

4.1 Ownership and License Grant

You retain ownership of your User Content. By making User Content available through the Services, you grant Source Interactive a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, adapt, publish, translate, create derivative works of, publicly display, publicly perform, and distribute such User Content in connection with operating, providing, promoting, and improving the Services and our business, in any media now known or later developed.

4.2 Feedback

If you send us suggestions, ideas, or feedback, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.

4.3 Your Representations

You represent and warrant that (a) you own or control all rights in your User Content; (b) your User Content does not infringe or violate any third-party right; and (c) your User Content complies with these Terms and all applicable laws.

4.4 No Obligation to Monitor

We have no obligation to monitor User Content but may review, remove, or restrict any User Content at our discretion, without notice, for any reason or no reason.

5. Prohibited Conduct

You agree not to, and not to permit any third party to:

Violate any applicable law, regulation, or third-party right.
Post or transmit content that is unlawful, harassing, defamatory, obscene, hateful, violent, sexually explicit (especially involving minors), threatening, or otherwise objectionable.
Impersonate any person or entity, or misrepresent your affiliation with anyone.
Interfere with, disrupt, overload, or compromise the security or integrity of the Services or their underlying infrastructure.
Circumvent or attempt to circumvent any access controls, rate limits, authentication mechanisms, geographic restrictions, age gates, or anti-cheat systems.
Collect or harvest data about other users without their consent.
Use the Services to distribute malware, spam, phishing content, or unsolicited commercial communications.
Engage in real-money trading of in-game items, account sales, boosting, or fraudulent transactions except through channels we expressly authorize.

6. Virtual Items, Digital Goods, and Purchases

The Services may offer virtual currency, tokens, in-game items, cosmetics, season passes, NFTs, subscriptions, and other digital goods (collectively, “Virtual Goods”).

No Real-World Value. Virtual Goods have no monetary value, cannot be redeemed for cash, and are licensed, not sold, to you for personal, non-commercial use within the Services.
No Transferability. Except where we expressly permit transfer (including certain blockchain-based assets governed by their own supplementary terms), Virtual Goods are non-transferable and non-refundable.
Pricing and Taxes. All prices are listed in U.S. dollars unless otherwise stated. You are responsible for all applicable taxes.
Refunds. All purchases are final except where required by law or expressly offered in our refund policy.
Modification or Termination. We may add, modify, suspend, or remove Virtual Goods and any associated game mechanics at any time without liability. When the Services or any portion of them are discontinued, your license to associated Virtual Goods will terminate.

7. Web3 and Blockchain Features (If Applicable)

Certain Services may involve blockchain wallets, NFTs, tokens, or other digital assets. You acknowledge and agree that:

Blockchain transactions are generally irreversible, and Source Interactive cannot recover lost keys, reverse transfers, or guarantee the value of any digital asset.
You are solely responsible for your wallet, gas fees, and tax obligations.
Regulatory treatment of digital assets is uncertain and may change. You assume all regulatory, technical, and market risk.
Any digital asset you acquire through the Services is governed by these Terms and any supplementary terms we provide for that asset.

8. Intellectual Property

The Services — including all software, game engines, game titles (including without limitation Source TCG, Helixia, Fusion Fighters, and Ark Arena), artwork, audio, characters, storylines, trademarks, logos, and branding — are owned by Source Interactive or its licensors and are protected by U.S. and international intellectual property laws. Nothing in these Terms transfers any ownership interest to you.

“Source Interactive,” “Source TCG,” “Helixia,” “Fusion Fighters,” “Ark Arena,” and related names and logos are trademarks of Source Interactive LLC. You may not use them without our prior written permission.

9. DMCA / Copyright Policy

We respect the intellectual property rights of others. If you believe content on the Services infringes your copyright, send a written notice to our designated agent containing:

Your physical or electronic signature.
Identification of the copyrighted work claimed to be infringed.
Identification of the allegedly infringing material and its location on the Services.
Your contact information.
A statement that you have a good-faith belief that the use is not authorized.
A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the copyright owner’s behalf.

Repeat infringers will have their accounts terminated.

10. Third-Party Services and Platform Integrations

The Services may integrate with or link to third-party services, including without limitation TikTok, Meta, Discord, Google, Apple, Twitch, YouTube, Steam, and various blockchain networks. Your use of those third-party services is governed by their own terms and privacy policies, and Source Interactive is not responsible for them.

10.1 TikTok Integration

If you connect a TikTok account to the Services or use any feature powered by TikTok APIs (including TikTok Login Kit, Display API, Content Posting API, or similar), you acknowledge and agree that:

Your use of TikTok features is also governed by the TikTok Terms of Service and the TikTok Privacy Policy.
Source Interactive receives data from TikTok only with your authorization and uses such data solely to provide the integrated features (for example, authentication, displaying your TikTok content within the Services, or publishing content you create to your TikTok account at your direction).
Source Interactive will not sell, rent, or disclose your TikTok data to third parties except as described in our Privacy Policy, as required by law, or as necessary to provide the Services.
You may disconnect your TikTok account at any time through your account settings or your TikTok app settings, which will revoke our access to your TikTok data on a going-forward basis.
TikTok is not a sponsor of, nor responsible for, the Services.

10.2 Other Platforms

Similar principles apply to other third-party platforms we integrate with. You grant us the right to transmit and receive the data necessary to provide integrated features at your direction.

11. Privacy

Your use of the Services is subject to our Privacy Policy, which describes what information we collect, how we use it, and your choices.

12. Beta and Experimental Features

From time to time we may offer beta, alpha, test, or early-access features. These features are provided “as-is,” may be unstable or incomplete, and may be modified or discontinued at any time. You use them at your own risk.

13. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOURCE INTERACTIVE AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DATA (INCLUDING USER CONTENT OR VIRTUAL GOODS) WILL BE RETAINED OR ACCURATE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SOURCE INTERACTIVE OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, OR COMPUTER DAMAGE, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO SOURCE INTERACTIVE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations; in those jurisdictions the foregoing limitations apply only to the maximum extent permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Source Interactive and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

16. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including breach of these Terms. You may stop using the Services at any time. Upon termination, your license to use the Services and any Virtual Goods ends. Sections intended by their nature to survive termination (including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Tennessee, U.S.A., without regard to its conflict-of-laws principles. You and Source Interactive agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Shelby County, Tennessee, and you consent to the personal jurisdiction of those courts.

17.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting source.interactive.games@gmail.com. We will try to resolve the dispute by contacting you via email. If a dispute is not resolved within 30 days of submission, you or Source Interactive may bring a formal proceeding.

17.2 Class Action Waiver

To the extent permitted by law, you and Source Interactive agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

18. Changes to the Services and Terms

We may modify, suspend, or discontinue the Services (or any part of them) at any time, with or without notice. We may also update these Terms from time to time. When we do, we will update the “Last Updated” date above and, for material changes, provide additional notice (for example, by email or an in-Service notification). Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

19. Export Controls and Sanctions

You may not use or export the Services in violation of U.S. export laws and regulations or any other applicable laws. The Services may not be used by, or exported to, any person or entity on a U.S. government restricted-party list or located in an embargoed country or region.

20. Miscellaneous

Entire Agreement. These Terms, together with our Privacy Policy and any supplementary terms, constitute the entire agreement between you and Source Interactive regarding the Services.
Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
Force Majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
Headings. Section headings are for convenience only and have no legal effect.
